CFTC opens a 60-day comment period on a rulebook for leveraged retail crypto trades
The agency published an advance notice of proposed rulemaking on Monday, the earliest formal step. It would create a registered "crypto asset market" category, but no rule text exists yet.
The Commodity Futures Trading Commission on Monday published an advance notice of proposed rulemaking, or ANPRM, asking the public how it should regulate retail crypto transactions under its own statute, according to the CFTC's press release. Bloomberg and Investing.com both headlined it as a proposed registration framework for crypto exchanges that offer leverage to retail customers.
The distinction matters for anyone trading on margin. An ANPRM is not a proposed rule. It contains no final text, no compliance dates and no fees. It is the agency saying what it intends to write and asking for help.
What the CFTC actually said
The release describes a "comprehensive regulatory framework" for retail commodity transactions in crypto assets under section 2(c)(2)(D) of the Commodity Exchange Act, which it abbreviates as "CTXs." It asks for comment on three things:
- how to prevent abusive practices in crypto markets under one national regime;
- how to give market participants crypto-specific context on practices the agency says it has seen work since it began overseeing parts of the crypto market in 2014;
- whether to write into rules a new subcategory of designated contract market, called a "crypto asset market," built only for these transactions.
Comments are due within 60 days of the notice appearing in the Federal Register. We could not find the Federal Register publication date in the release, so the exact deadline is not yet known. The agency says it will use the comments to inform "potential future agency action, such as a rulemaking," which is deliberately non-committal.
Chairman Michael Selig said the step helps America "remain the crypto capital of the world" and that the agency wants rules that "prevent, rather than only prosecute after the fact, fraudulent schemes such as FTX."
The number behind the headline: where this sits in the queue
On September 22 we reported that the CFTC's crypto rule was at the White House for review but was only at the pre-proposal stage, after the Senate failed to advance the Clarity Act. Monday's notice is consistent with that: the agency has now put the pre-proposal in front of the public. We have not matched this notice to the specific item on the White House review list, so we are not saying they are the same filing.
The sequence from here is a comment period, then a proposed rule with actual text, then a second comment period, then a final rule. Each step usually takes months. Nothing in Monday's notice changes what an exchange or a trader can do today.
Who it would hit
The release does not name platforms. A registered "crypto asset market" category would give the agency a formal hook over venues that serve retail customers in these transactions, and the headlines from Bloomberg and Investing.com say leverage is the focus. Which platforms would qualify, what capital and disclosure rules they would face, and how leverage limits would work are all open questions in the notice.
For a trader, the practical read is narrow. If you use leverage on a US-facing platform, the rules that govern it may change in 2027 or later. If you only buy spot coins, this notice does not address you. Bitcoin was near $85,200 on Coinbase at midday and moved little on the news, down about 0.1% over 24 hours. What we are watching
Three things: the Federal Register date that starts the 60-day clock, whether the SEC issues a matching notice on custody and spot trading, and whether Congress revives the Clarity Act, which would override much of this. We will update when the comment deadline is published.
