Houston mayor orders police to stop routine ICE alerts after Democrats' Texas sweep

Mayor John Whitmire said "elections matter" as he limited Houston police cooperation with federal immigration officials. Governor Greg Abbott, who lost his re-election bid, has threatened to pull funds from cities that do this.

Houston Mayor John Whitmire, a Democrat, has directed the city's police to limit cooperation with federal immigration authorities, the BBC reported on Saturday. AP, Reuters, The New York Times, The Texas Tribune and Houston Public Media also ran headlines on the order.

What changes

Whitmire made the change through an executive order. Under the old rules, the BBC reports, a Houston officer who ran a person through the National Crime Information Center database and found an administrative ICE warrant had to tell ICE. Those warrants are issued inside the Department of Homeland Security, not by a judge.

Police Chief Noe Diaz said that officers will now contact ICE only when someone arrested for a jailable offense also has such a warrant. His example: a driver stopped for a minor traffic infraction gets a citation "and goes about their day."

The BBC also reports that Austin has begun a similar policy change.

What each side said

Whitmire said he acted "to begin a healing process" and to "reduce fear and anxiety across our community," adding: "I also do this knowing that elections matter." He called on Congress to change federal immigration rules, saying ICE needs better training, body cameras and de-escalation training, and that "this can only be done in Washington."

A DHS spokesperson told Houston's NBC affiliate, KPRC 2, that the department is "disappointed that sanctuary politicians seek to limit cooperation with ICE," and that local partnerships are "critical to having the resources we need." The BBC says it asked Governor Abbott's office for comment. Abbott has threatened to withhold millions of dollars from Houston, Dallas and Austin unless their police fully cooperate with federal immigration officials.

Why now

The BBC links the timing to Tuesday's midterms, in which Democrats won both chambers of Congress and Texas elected Gina Hinojosa governor, the first Democrat to win the office since 1995. See our report on what her win means for business.

The BBC also notes that Houston has seen months of protests after an ICE officer fatally shot Lorenzo Salgado Araujo, a 52-year-old Mexican national, earlier this year. DHS said he was not the intended target. Whitmire had previously resisted calls for a change like this, the BBC says, over concerns that the White House could send a surge of immigration officers.

The money angle, and what is still unknown

The open question is the funding threat. Abbott has said state money is at risk for cities that do not cooperate, but we have not seen a figure or a legal mechanism for withholding it, and we are not stating one. If the state follows through, it would hit a city budget that pays for police, roads and services that local employers rely on. Whether it will is not known, and Abbott's office had not been quoted on the new order in the reports we read.

For owners in Houston, nothing changes in federal enforcement, which the order does not touch. What changes is the local routine at traffic stops and minor arrests.
