Incoterms are standard trade terms from the International Chamber of Commerce that set who pays for transport, insurance and customs, and where risk passes from seller to buyer.

Definition

Incoterms are a set of internationally recognised rules, published by the International Chamber of Commerce, that define the responsibilities of seller and buyer in a sale of goods. They cover delivery point, risk transfer, and who handles export and import clearance.

A plain example

A contract might say a term followed by a named place. That pairing tells both sides where the seller's duty ends and the buyer's begins. A buyer reading the quote can then work out which freight and insurance costs still have to be added.

Why it matters

Without a clear term, disputes arise over who pays for damage in transit or for unloading. The term also decides what to include in a landed cost calculation, so it should be agreed before the order, not after.

Common confusion

Incoterms are not a contract of sale and do not cover payment terms, transfer of title or remedies. They also apply to a stated edition, so name the edition in the contract. Some terms apply only to sea transport, which is a frequent source of mistakes.

On a project

Write the term, the named place and the edition into the purchase order. Then list the costs each side pays, and check them against the quote before you sign.

Quick answers

  • Who publishes Incoterms? The International Chamber of Commerce.
  • Do Incoterms cover payment? No. They cover delivery, risk and costs related to transport, not payment terms or title.
  • Why name the edition? The rules are revised periodically, and the contract should state which version applies.

Always check the project drawings and specification, and confirm requirements with the engineer of record and the local authority.
